
Justice Richard Mwongo will make the determination after the Wiper Democratic Movement sought the court’s intervention when it learnt that Mutula Jr’s name was missing on the ballot papers.
According to the Independent Electoral and Boundaries Commission (IEBC), it will not be the first time a candidate’s name is being superimposed on already printed ballot papers due to late entry.
The electoral body intends to superimpose Mutula Jr’s details on the ballot papers because he was nominated after the printing was finalised.
The electoral body has indicated that it will be too late to print fresh ballot papers since the ready ones were due to arrive in the country from the UK later on Wednesday afternoon.
