NAIROBI, Kenya, Dec 4 – The Director of Public Prosecutions Keriako Tobiko has directed that National Super Alliance advisor David Ndii be released on police bond.
Tobiko has also directed that once investigations into Ndii are complete, the file be forwarded to him for further direction.
Ndii was taken into custody by police on Sunday, while on vacation with his family in Diani, before being transferred to the Directorate of Criminal Investigation headquarters on Kiambu Road.
He was detained there for the better part of the day with pressure coming from his wife Mwende Gatabaki, Opposition leader Raila Odinga and the wider NASA fraternity, for his release.
“This is not transparent, my husband is not a criminal. I asked those people (the police) what crime has he committed? (And) they couldn’t tell me.” Mwende told the press on Monday as she called on President Uhuru Kenyatta to intervene.
He was arraigned at the Milimani Law Courts on incitement charges for stating that “if change did not come through the ballot, it would come by the bullet” but was released without charges being read to him.
Ndii has defended his statements on secession as philosophical and not subversive with his family and the Opposition viewing his arrest as reminiscent of retired President Daniel Arap Moi’s era when the state machinery was manipulated in a clampdown on dissenters.
“I know that other people are going to be arrested,” Odinga said in response to Ndii’s arrest.
Ndii has been one of the brains behind NASA’s response to President Kenyatta’s re-election.
