NAIROBI, Kenya, June 23 – Kenya Reinsurance Corporation has accused the chairperson of the Commission on Administrative Justice (CAJ), Charles Dulo, of defying a High Court order by taking action in an ongoing judicial review matter despite explicit directions from the court to refrain from doing so.
In a letter dated June 12, 2025, Manyonge Wanyama & Associates LLP warned the CAJ Chair that he risks being cited for contempt of court after issuing a disputed ruling against their client a day after the Employment and Labour Relations Court (ELRC) had barred the Commission from proceeding with investigations and summons against Kenya Re.
“Lady Justice Stella Ruto issued express, clear and unequivocal orders that because of the pendency of the referenced judicial proceedings, the Commission on Administrative Justice should cease any further action,” wrote lead counsel Peter Wanyama.
The judicial order, made on June 9 in the presence of CAJ’s in-house counsel, suspended any implementation of a Notice of Investigations dated April 25, 2025, and Summons issued on May 13, 2025. However, the lawyers allege that Mr. Dulo went ahead and issued a backdated ruling on June 10 in violation of the court’s instructions.
“We know that you were appointed this year, and you want to exercise your ‘full powers’, untrammeled, unhindered and to the extreme. In fact, the other day you attempted to summon the Chief Justice!” the letter reads, in an unusually direct tone that questions the Chairperson’s commitment to judicial oversight.
Kenya Reinsurance Corporation has demanded that the commission withdraw the ruling in question and halt further action, warning that failure to do so within three days will result in contempt proceedings being initiated.
The dispute arises from Judicial Review Application No. E033 of 2025 before the Nairobi High Court, in which Kenya Reinsurance Corporation is challenging the CAJ’s investigative actions. The firm maintains that the matter is sub judice, and any administrative move risks undermining judicial authority.
