Kenya Power, Unga Farm Care consignments face possible KRA auction

NAIROBI, Kenya, Aug 18 – Kenya Power and Lighting Company, Unga Farm Care (EA) Limited, Enzi Motors Company Limited and other businesses and individuals have had consignments listed by the Kenya Revenue Authority (KRA) as overstayed goods in customs warehouses, putting them at risk of public auction if they are not cleared within the period provided under customs law.

A notice published in the Kenya Gazette on August 14, 2026 gives the affected owners 30 days to enter and remove the goods from customs custody, failure to which they will be treated as abandoned and disposed of in accordance with the East African Community Customs Management Act (EACCMA), 2004.

“Unless the under-mentioned goods are entered and removed from the custody of the Customs Warehouse Keeper, Inland Container Depot Nairobi within thirty (30) days of this notice, they will be treated as abandoned and will be disposed of in accordance with the provisions of EACCMA, 2004 including being sold by public auction,” the notice states.

KRA has scheduled the auction for September 28, 29 and 30 and October 1 and 2, 2026 through its online auction platform. Interested buyers will be allowed to inspect the goods on September 24 and 25 at the locations indicated in the notice.

The seven lots are held at the Syokimau Inland Container Depot and are listed under lot numbers 3301/EMK/CW/H/26 through 3307/EMK/CW/H/26.

Unga Farm Care is listed against eight 40-foot containers aboard the vessel Ef Olivia carrying Indian non-GMO soyabean.

The Unga consignments have dates in of April 27 and April 29, 2026, and are linked to bill of lading number EMIVINDMUN230182. The individual Gazette entries describe the goods as Indian non-GMO soyabean and list them at the Inland Container Depot in Nairobi.

The Gazette notice does not give the reasons why the Kenya Power or Unga Farm Care consignments remained in customs custody, nor does it state that the companies had failed to pay taxes or other charges.

The list also includes several consignments linked to the automotive sector.

Enzi Motors Company Limited is listed against a 40-foot container aboard MSC Guernsey V, with a date in of April 11, 2026. The consignment contains 175 packages of electric motorbikes and related spare parts and is listed at Chai Logistics.

The notice was issued under Section 42 of the EACCMA, which provides for the disposal of goods that remain in customs warehouses beyond the prescribed period.

KRA guidance states that goods advertised for auction may still be withdrawn before the sale if the owner establishes ownership and meets the applicable customs requirements, including entering the goods, making the required declarations and paying applicable taxes.

The authority also says goods placed on auction lists are subject to verification by Customs and other relevant government agencies. Goods that fail applicable quality standards, are expired or counterfeit may be destroyed instead of being sold.

Being listed in the auction notice therefore does not, by itself, establish that an importer has evaded taxes or deliberately failed to clear a consignment.

For the businesses and individuals named in the August 14 notice, the immediate requirement is to have the affected goods entered and removed, or otherwise withdrawn from the auction process, within the prescribed period.

The scheduled auction will run from September 28 to October 2, with prospective buyers allowed to inspect the goods on September 24 and 25.
