Appeals Court to hear presidential vote tally petition

NAIROBI, Kenya, Jun 6 – The hearing of an appeal contesting the ruling on the final declaration of presidential election results at the constituency level is set to commence on Tuesday.

The two-day sitting will be presided by a five-judge bench which will handle the dispute lodged by the Independent Electoral and Boundaries Commission (IEBC) and supported by the Attorney General.

Court of Appeal President Justice Paul Kihara had stated that the bench will not entertain sideshows since the legal issues under consideration are complex and have attracted considerable public interest.

The electoral body is aggrieved by the April 7 decision by High Court Judges Aggrey Muchelule, Weldon Korir and Enock Chacha-Mwita that results of the presidential race should be declared exclusively by the 290 constituency returning officers and not subject to confirmation by anyone else.

The agency however argued that the IEBC chair should be the returning officer for presidential poll.
