NAIROBI, Kenya Aug 7 – FORD-Asili has called for a general election to be held within 90 days following a High Court ruling it says determined that Kenya’s general elections should be held every four years rather than five.
Justice Mugure Thande ruled that Kenya’s next presidential election should constitutionally have been held on August 11, 2026, and not in August 2027 as announced by the Independent Electoral and Boundaries Commission.
In a statement, Secretary General Njeru Kathangu argues that the ruling means President William Ruto’s term expires on August 11, 2026, and urged authorities to begin preparations for what he described as a constitutionally required snap election.
Kathangu said the party had consistently maintained that Kenya’s Constitution provides for four-year presidential terms.
“After Sixteen years of constitutional misinterpretation and sustained illegality in three unconstitutional governments, the High Court sitting in Malindi this morning, ruled that Kenyan general elections are supposed to take place after every four years and not the traditionally inherited five years from the British colonialists,” the FORD Asili said.
He claimed that postponing the next General Election to August 2027 would amount to violating the Constitution.
FORD-Asili further said the Independent Electoral and Boundaries Commission (IEBC) had already received funding to prepare for elections, adding that the country was capable of conducting a fresh poll within the proposed timeframe.
The party maintained that compliance with the Constitution should take precedence over political considerations, saying constitutional interpretation should not be influenced by concerns over political stability.
Kathangu said FORD-Asili was prepared to field what he described as a “mature, worthy and caring patriotic candidate” should a snap election be called.
