NAIROBI, Kenya, Sept 24 – The owners of Naivas supermarket chain have moved to court seeking to restore an affiliated human resource outsourcing company that was struck off the Companies Register in May.
The case involves Achievo Limited, company number CPR/2013/117634, whose dissolution was published in Gazette Notice No. 8218 on May 29, 2026.
The applicants want the High Court to suspend the dissolution pending determination of the case, arguing that the company’s bank accounts, property and business operations should not be treated as bona vacantia, or property without a legal owner.
They are also seeking an order directing the Registrar of Companies to restore Achievo to the Companies Register.
The applicants have proposed that Achievo be given 60 days after restoration to file all outstanding annual returns, or another period determined by the court.
They have also asked the court to validate contracts, transactions, payments, statutory remittances and legal proceedings undertaken by or against the company between its dissolution and restoration.
The application is before Lady Justice Rhoda Rutto under High Court Commercial and Tax Division case number HCCOMMISC/E1022/2026.
The applicants have asked the court to certify the matter as urgent and issue directions that would, as far as practicable, place Achievo and affected parties in the position they would have occupied had the company not been dissolved.
