NAIROBI, Kenya, Jul 26 – The High Court has appointed an official liquidator to oversee the winding up of property developer Banda Homes Limited, marking the next phase in the company’s insolvency proceedings and paving the way for creditors to submit claims against the firm.
A notice published in the Kenya Gazette states that insolvency practitioner Waithaka Ngaruiya was appointed liquidator of Banda Homes Limited effective July 2, 2026, under Section 439(1) of the Insolvency Act, following proceedings in Insolvency Petition No. E44 of 2021.
The appointment transfers control of the company’s affairs, business and assets to the liquidator, who is mandated by the court to take possession of the company’s property, preserve its assets and administer the liquidation process in accordance with the Insolvency Act.
Creditors and other parties with claims against Banda Homes have been given 60 days from the date of the notice to submit proof of debt forms together with supporting documentation for consideration during the liquidation process.
“By virtue of the appointment, the affairs, business and property of the Company are vested in and subject to the control of the Liquidator.”
“Pursuant to Section 444 of the Act, the Liquidator is authorized to take possession, control and custody of all property to which the Company is or appears to be entitled.”
The Gazette notice states that all claims must be submitted using the prescribed Proof of Debt form available through the Business Registration Service, alongside the necessary supporting documents.
The liquidation process is designed to establish the company’s assets and liabilities before determining how available assets, if any, will be distributed among creditors in line with the order of priority set out under Kenya’s insolvency laws.
The notice directs that all correspondence, enquiries and claims relating to Banda Homes Limited be addressed to the appointed liquidator through Waithaka and Associates Advocates in Nairobi.
