NAIROBI, Kenya, Mar 7 – The current Athletics Kenya (AK) officials led by its president LT. GEN. (RTD) Jackson Tuwei have been ordered to vacate office with immediate effect by the High Court of Kenya.
In a ruling delivered on Thursday by Judge Lawrence Mugambi, the court found that the Tuwei led team had overstayed in office and have completed their two terms of eight years as manded by the Sports Act 2013 and will not be eligible to contest for any position in the federation.
“An order be and is hereby issued that by dint Sections 46 and 49 of the Sports Act and the second schedule thereof, the officials and Executive Committee of the 1st respondent (Athletics Kenya, Tuwei, Paul Mutwii, David Miano) who have been in office for a cumulative period of 8 years since the coming into force of the Sports Act have served their terms in full and must forthwith vacate office. They shall be ineligible to contest for any position in the organization,” the order read.

Tuwei and team were also ordered to review the constitution of AK adopted and ratified on 27th April 2016 within the next 90 days of making of the order with a view of considering public views gathered during its last review for purposes of enhancing exclusivity, democratic representation of various players in athletics and ensure transparency in areas of concern raised by the stakeholders.
The petition was filed by Kenya’s athletics legend Moses Tanui who is a two time Boston Marathon champion in 1996 and 1998 and a 1991 world champion in 10,000m in Tokyo.

In a quick rejoinder, AK chairman in charge of Youth Barnaba Korir told Capital Sport that they have applied for a stay order which they have been granted.
“There is nothing to worry, we have been granted stay orders by the court because we are in the middle of preparing our athletes for the Africa Games and other major upcoming events like the Olympics. We will follow the law and what the court says,” Korir said.
The current AK office also has Paul Mutwii as its senior vice president, David Miano as Hon. Treasurer, Barnaba Korir, Dimy Kisalu, Benjamin Njoga, and Elizabeth Keitanny as members.
