NAIROBI, Kenya, May 13 – The Ethics and Anti-Corruption Commission (EACC) has issued model procedures targeted at combating corruption and bribery.
According to the Commission, the procedure guidelines will help prevent acts of corruption and bribery for both public and private entities in line with the Anti-Bribery Act, 2016 and the Anti-Bribery Regulations, 2022.
“These Procedures are developed pursuant to section 9(1) of the Anti-Bribery Act which provides that public and private entities shall put in place procedures appropriate to their size, scale and nature of their operations for the prevention of bribery and corruption,” EACC stated.
The procedures, which will provide the accepted standards in relation to the prevention of bribery and corruption, will also serve as a practical tool for the prevention of bribery and corruption as required under the Anti-Bribery Act.
“These Procedures supplement the Anti-Bribery Act, the Regulations and the Guidelines. In particular, these Procedures clarify the measures for the prevention of bribery and corruption. The Commission said the Procedures will apply to the board of directors, management, employees, third parties and stakeholders of the entity,” it added.
The model proposed by the commission proposes guidelines for bribery offenses, penalties under the Act, managing third parties, reporting mechanisms, and protection of whistleblowers, informants, and witnesses.
The commission also listed conflicts of interest, human resource management, donations, including political donations, collections, and harambees, as well as sponsorships and grants, as the main high-risk areas involved in most entities’s bribery and corruption risk assessments.
