NAIROBI, Kenya, Feb 9 – The High Court has declared Jacque Maribe’s account on the gun shooting incident at her house as false.
Justice Grace Nzioka indicated that her statement was inconsistent with the alleged robbery.
“The second accused person (Jacque Maribe) contradicts her own statement with the statements of the 30th and says the statement I gave yesterday was a lie. Once evidence is produced as an exhibit, the court uses it,” she stated.
“It is the finding of this code where the report made to the police by the first accused person and the second accused person on 28th of September was false,”
“The first accused person expressly admitted he lied in his evidence in this court before this court,” stated Nzioka.
Justice Nzioka pointed out the statement from Royal Par Estate where Maribe and his ex-lover Jowie resided showed there was no shooting incident within Maribe’s house as she alluded to in her evidence.
“Eunice Muhammad who was the caretaker at Royal Park said no saying if there was an incident at the main gate, he would have known as a caretaker,”
“The neighbor Kassaine said if there was such incident in the estate it would have been posted in the Estate Association Whatsapp group, it wasn’t,” Nzioka stated.
According to the statement, Maribe told police that his fiancé tried to commit suicide by shooting himself just below his left shoulder.
This happened on the night of September 20 at around 1am.
Police had treated both Jacque Maribe and her fiancé Joseph Irungu as prime suspects in the murder of Kimani.
This is after Maribe contradicted her initial statement on Jowie’s gunshot injury with several other incriminating items recovered in her house.
Police found a partly burnt kanzu and Jacket worn by Jowie on the night Monica was murdered was found behind Maribe’s house in Lang’ata.
Also found were items taken from Monica’s apartment and a live 9mm bullet that was recovered under Maribe’s bed.
