Kibera court hands man 60-year jail term for defiling 2-year-old

NAIROBI, Kenya, Dec 19 — A Kibera court has sentenced a man to 60 years in jail for the offense of defiling a 2-year-old child.

The prosecution had charged the convict, Rodgers Alianda Atseka, with two counts: Defilement Contrary to Section 8(1) as read with Section 8(2) of the Sexual Offences Act No. 3 of 2006 and Committing an Indecent Act with a Child, contrary to Section 11(1) of the Sexual Offences Act No. 3 of 206.

The convict lured the minor on July, 25, 2022, from where she was playing with her friends in the pretext of going to buy her candies, the Office of the Director of Public Prosecution stated.

“The prosecution through Jane Gitahi produced called witnesses, and when the accused was placed on his defense, he was unable to dislodge the prosecution case,” ODPP said.

Elsewhere, a 47-year-old Tana River County, a court in Hola jailed a primary school head teacher for 15 years for defiling a 16-year-old pupil.

Athman Mohammed Jillo lured the minor into sexual activities in exchange for a good grade in the Kenya Certificate of Primary Education (KCPE).

While issuing out the sentence, Hola Resident Magistrate Benson Kabanga said that the prosecution had proven the case beyond any reasonable doubt.

The prosecution, led by Prosecution Counsel Michuki Alfred, called eight (8) witnesses who testified and established a case against the accused person.

In his sentence, Kabanga stated that Jillo abdicated his responsibility to protect his student from any form of harm or abuse.
